MADRID (AP) ? Spain's Interior Ministry says police have arrested 17 people on suspicion of smuggling Nigerian women into Spain and forcing them into prostitution using threats including claims they would cast Voodoo spells on them if they didn't comply.
An investigation began when police detected in January that around 10 women had been brought into the country illegally using a small boat.
Police said that following an investigation its raids seized computer equipment, mobile phones, false identity and work permit documents, as well as objects which detectives said were allegedly used in "Voodoo rituals."
Officers tracked down the suspected pimps in cities throughout Spain and arrested 16 Nigerian nationals and one Ugandan citizen, a statement released Sunday said. It was not clear when the arrests took place.

This is a recipe my father used back in the 40?s. Many years ago, I found it among his things, but never made it until tonight. Now I will never make any other version. It?s really airy yet creamy, with just the right balance of booze.

Note that this recipe uses raw eggs. If this scares you, I doubt you?d be on this site anyway, but normal warnings apply. Use good, clean eggs and break them correctly (not on the side of a bowl).
Egg Nog
Beat 8 egg whites until stiff peaks.
Add 1/2 cup sugar and beat until incorporated. Set aside for a moment.
Beat 8 egg yolks and 1/2 cup sugar.
Put the whites back on the mixer, and fold in the beaten yolks
At a slower speed, add 1 qt heavy cream, 1 pt whole milk, beat some more.
Add 2 cups rum and 1/2 cup bourbon.
Take 20 mg Lipitor.
Pour into glasses, dust with freshly ground nutmeg

PYONGYANG, North Korea (AP) ? North Koreans across the country stopped in their tracks at midday Monday to silently honor former ruler Kim Jong Il, whose death one year ago swept his untested 20-something son to power.
Pyongyang construction workers took off their yellow hard hats and bowed at the waist as sirens wailed across the city for three minutes. The son, Kim Jong Un, presided over a solemn ceremony to reopen the sprawling granite mausoleum where his father's embalmed remains will lie in state near those of his grandfather, the nation's founder Kim Il Sung.
Tens of thousands of North Koreans gathered in the frigid plaza outside the renovated hall where Kim Jong Il's body was to go on public display later Monday. Lined with snow-tinged firs, the square has been turned into a park at Kim Jong Un's orders and his father's portrait installed on the building's fa?ade alongside that of Kim Il Sung.
The elder Kim died last Dec. 17 from a heart attack while traveling on his train. His death was famously followed by scenes of North Koreans dramatically wailing in the streets of Pyongyang, and of his pudgy young son leading ranks of uniformed and gray-haired officials through a series of funeral and mourning rites.
The mood in the capital was decidedly more upbeat a year later, with some of the euphoria carrying over from last week's successful launch of a rocket carrying a satellite named for one of Kim Jong Il's many titles, Kwangmyongsong, or "Lode Star," a nickname given to him at birth according to the official lore.
Speaking outside the mausoleum, renamed the Kumsusan Palace of the Sun, the military's top political officer, Choe Ryong Hae, said North Korea should be proud of the satellite, calling it a show of strength to the world.
Much of the rest of the world, however, was swift in condemning the launch, which was seen by the United States and other nations as a thinly disguised cover for testing missile technology that could someday be used for a nuclear warhead.
The test, which potentially violates a United Nations ban on North Korean missile activity, underlined Kim Jong Un's determination to continue carrying out his father's hardline policies even if they draw international condemnation.
Some outside experts worry that Pyongyang's next move will be to press ahead with a nuclear test in the coming weeks, a necessary next step toward building a warhead small enough to be carried by a long-range missile.
Despite inviting further isolation for his impoverished nation and the threat of stiffer sanctions, Kim Jong Un won national prestige and clout by going ahead with the rocket launch.
At a memorial service on Sunday, North Korea's top leadership not only eulogized Kim Jong Il, but also praised his son. Kim Yong Nam, president of the Presidium of North Korea's parliament, called the launch a "shining victory" and an emblem of the promise that lies ahead with Kim Jong Un in power.
The rocket's success also fits neatly into the narrative of Kim Jong Il's death. Even before he died, the father had laid the groundwork for his son to inherit a government focused on science, technology and improving the economy. And his pursuit of nuclear weapons and the policy of putting the military ahead of all other national concerns have also carried into Kim Jong Un's reign.
In a sign of the rocket launch's importance, Kim Jong Un invited the scientists in charge of it to attend the mourning rites in Pyongyang, according to state media.
The reopening of the mausoleum on the first anniversary of the leader's death also follows tradition. Kumsusan, the palace where his father, Kim Il Sung, served as president, was reopened as a mausoleum on the first anniversary of his death in 1994.

Dec. 13, 2012 ? For over 25 years, Paul Sternberg has been studying worms -- how they develop, why they sleep, and, more recently, how they communicate. Now, he has flipped the script a bit by taking a closer look at how predatory fungi may be tapping into worm conversations to gain clues about their whereabouts.
Nematodes, Sternberg's primary worm interest, are found in nearly every corner of the world and are one of the most abundant animals on the planet. Unsurprisingly, they have natural enemies, including numerous types of carnivorous fungi that build traps to catch their prey. Curious to see how nematophagous fungi might sense that a meal is present without the sensory organs -- like eyes or noses -- that most predators use, Sternberg and Yen-Ping Hsueh, a postdoctoral scholar in biology at Caltech, started with a familiar tool: ascarosides. These are the chemical cues that nematodes use to "talk" to one another.
"If we think about it from an evolutionary perspective, whatever the worms are making that can be sensed by the nematophagous fungi must be very important to the worm -- otherwise, it's not worth the risk," explains Hsueh. "I thought that ascarosides perfectly fit this hypothesis."
In order to test their idea, the team first evaluated whether different ascarosides caused one of the most common nematode-trapping fungi species to start making a trap. Indeed, it responded by building sticky, web-like nets called adhesive networks, but only when it was nutrient-deprived. It takes a lot of energy for the fungi to build a trap, so they'll only do it if they are hungry and they sense that prey is nearby. Moreover, this ascaroside-induced response is conserved in three other closely related species. But, the researchers say, each of the four fungal species responded to different sets of ascarosides.
"This fits with the idea that different types of predators might encounter different types of prey in nature, and also raises the possibility that fungi could 'read' the different dialects of each worm type," says Sternberg. "What's cool is that we've shown the ability for a predator to eavesdrop on essential prey communication. The worms have to talk to each other using these chemicals, and the predator is listening in on it -- that's how it knows the worms are there."
Sternberg and Hsueh also tested a second type of fungus that uses a constricting ring to trap the worms, but it did not respond to the ascarosides. However, the team says that because they only tested a handful of the chemical cues, it's possible that they simply did not test the right ones for that type of fungus.
"Next, the focus is to really study the molecular mechanism in the fungi -- how does a fungus sense the ascarosides, and what are the downstream pathways that induce the trap formation," says Hsueh. "We are also interested in evolutionary question of why we see this ascaroside sensing in some types of fungi but not others."
In the long run, their findings may help improve methods for pest management. Some of these fungi are used for biocontrol to try and keep nematodes away from certain plant roots. Knowing more about what stimulates the organisms to make traps might allow for the development of better biocontrol preparations, says Sternberg.
The full results of Sternberg and Hsueh's study can be found in the paper, "Nematode-trapping fungi eavesdrop on nematode pheromones," published in the journal Current Biology.

Nearly half of women who became pregnant through in vitro fertilization (IVF) after age 40 say they were "shocked" to discover they needed fertility treatments, a new study finds.
In the study, the researchers at the University of California, San Francisco interviewed women from 61 families ? including heterosexual couples, lesbian couples and single women ? who conceived and delivered children via IVF after age 40. The interviews were done between 2009 and 2011.
"We found that women did not have a clear understanding of the age at which fertility begins to decline," the researchers wrote in their study, published online Nov. 30 in the journal Human Reproduction.
Most women thought their fertility would last longer than it did. For instance, 31 percent said they expected to get pregnant without difficulty at age 40.
"Very few participants had considered the possibility that they would need IVF, and 44 percent reported being ?shocked? and ?alarmed? to discover that their understandings of the rapidity of age-related reproductive decline were inaccurate," the researchers wrote.
However, fewer than a quarter of these women said they would have tried to get pregnant earlier if they had more information about declining fertility, the study found. For women in the study, "personal-life circumstances would not have encouraged them to begin childbearing earlier than they did," the researchers wrote.
Along with a decline in the chance of conceiving naturally, the chance of successfully having a baby via IVF?also declines with age ??the chance of success with one cycle of IVF treatment drops from 41 percent at age 35, to 4 percent after age 42. Studies have shown the general public is not aware of the extent of this decline, the researchers said.
Three-quarters of the women said they felt lucky about successfully conceiving through IVF.
The researchers noted that their study participants were a selected group of women, and the study was retrospective. Studies that follow women forward over time, and test other populations are needed to confirm the results.
According to statistics from the Centers for Disease Control and Prevention, infertility affects nearly 12 percent of reproductive-age women in the U.S. Part of the reason for this is cultural trend of women delaying childbearing, according to the study. One in five women now has her first child after age 35, an eightfold increase compared with a generation ago.
When the researchers probed into why the study participants held mistaken beliefs about fertility, 28 percent said that incorrect information from friends, doctors or the media reinforced the idea that older women could easily become pregnant. For example, a 42-year-old woman recalled thinking, "Everyone?s having babies at 42 ? all the superstars are having them," according to the study.
About a quarter of participants said their beliefs stemmed from messages about preventing pregnancy they had received since adolescence. One woman wrote, "It?s like, all of our lives we?re terrified we?re going to get pregnant too soon and have a child and ruin our lives ? and, actually, it?s not that easy."
A quarter of participants also said their beliefs were based on their mothers?, sisters? or their own previous fertility.
It remains unclear exactly what can be done to better educate women about fertility. Researchers have been slow to get information about fertility declines out to the public, according to the study. For example, a 1982 report from French researchers was the first large study to show a decline in artificial insemination success rates as women aged, but it wasn't until 2000 that the American Society for Reproductive Medicine (ASRM) recommended that women over 35 trying to conceive be counseled and treated more quickly than younger women.
And messages about declining fertility could also have "unwelcome social implications," the researchers said. A public education campaign that the ASRM undertook between 2000 and 2002 was criticized for pressuring women to have children before they were ready, and for undermining women's efforts to become educated and have careers.
However, the trend of women delaying childbearing has continued, and data show that IVF can only partly offset fertility declines. "These projections make a case for renewed attempts to educate women and men about the known parameters of fertility at all life stages," the researchers wrote.

NEW YORK (Reuters) - New York City's subway system will resume limited operations on Thursday, four days after it was shut down ahead of the arrival of Sandy, the massive storm that brought unprecedented flooding to the world's financial capital, New York Governor Andrew Cuomo said.
Limited service on suburban commuter rail lines serving Long Island to the east and Westchester County and Connecticut to the north was to resume on Wednesday afternoon, Cuomo said at a press conference. Trains were to begin operating on the Long Island Railroad and Metro North Railroad systems at 2 p.m. (1800 GMT) on Wednesday.
Cuomo said the restored subway service would be supplemented by a "bus bridge" between Manhattan and Brooklyn given that four of the seven tunnels connecting the two boroughs under the East River remain flooded. Three of the seven tunnels were now clear of water, he said.
In Manhattan, there would be no subway service south of 34th Street, Cuomo said.
New York City was brought to a near standstill by flooding, power outages and transportation closures after the storm hit Monday night.
The city counts an average of 5.3 million riders each weekday. The system, which runs around the clock, comprises 21 subway routes linked by 468 stations, and stretches across 660 miles of track.
Cuomo said officials faced huge task to restore not only transportation services but other key portions of the city's infrastructure damaged when Sandy swept a record storm surge of nearly 14 feet over southern Manhattan and other low-lying waterfront neighborhoods.
"It was frightening. It was frightening. It looked apocalyptic," Cuomo said of the flooding he witnessed on Monday night at the height of the storm.

When Republican vice presidential nominee Paul Ryan rinsed a few dishes in the back of a soup kitchen in Youngstown, Ohio, he couldn't have known the photo op would still be a story almost a week later. It is, but not for anything positive.
According to The Huffington Post, the Mahoning County St. Vincent De Paul Society is losing donors as a result of the photo.? "It appears to be a substantial amount," charity president Brian Antal told the Post. "You can rest assured there has been a substantial backlash." Antal declined to mention specific numbers, citing privacy concerns.
For those who haven't been following, er, soup-kitchen-gate, here's what happened. Rep. Ryan stopped by on Saturday morning and offered to wash a few dishes. However, according to Antal, the Ryan camp wasn't exactly invited.
"We are apolitical because the majority of our funding is from private donations," Antal told The Washington Post. "It's strictly in our bylaws not to do it. They showed up there, and they did not have permission. They got one of the volunteers to open up the doors." Antal also said that "If this was the Democrats, I'd have the same exact problem."
A spokesperson for Ryan told the Washington Post that a staff member reached out to the charity before stopping by and was told that "it would be fine for the congressman to stop by."

As campaign days dwindle, candidates quicken their pace. Every audience becomes extremely important, rallies usually become larger, noisier and more energetic and campaign travel becomes busier and focused on key battleground states ? where political television ads now blare nearly around-the-clock.
Both candidates also are extending their outreach in the final days to important voting blocs, most recently women. The president has held a lead with women voters in most polls, but some recent surveys suggest some shifting loyalties.
Republican Mitt Romney's debate remarks that he had reviewed "binders full of women" for top-level jobs when he was governor of Massachusetts gave President Barack Obama new ammunition.
"We don't have to order up some binders to find qualified, talented, driven young women to learn and teach and thrive and start businesses," Obama said after the debate.
Two days after their combative second debate, both Obama and Romney were to share another platform as both address an annual Catholic charity banquet in New York.
But the tone is sure to be less tense. Presidential candidates usually make humorous remarks, poking fun at both opponents and themselves at the annual Alfred E. Smith Memorial Foundation Dinner, a white-tie event named after a former New York governor. Four years ago, Obama and John McCain swapped self-deprecating jokes instead of campaign jabs at the same dinner.
On the way to New York, Obama attended an outdoor campaign rally in Manchester, N.H. where he taunted Romney's efforts to promote his economic plan, which Democrats claim mostly benefits the wealthy.
Vice President Joe Biden campaigned in Nevada for a second day and GOP vice presidential candidate Rep. Paul Ryan had two campaign stops in Florida.
The final presidential debate is Monday in Boca Raton, Fla.

That is the question behind a provocative new study from an influential Washington think tank.
True, retired veterans are private citizens. But there is a ?fine line? between vets voicing private concerns and doing so in a way ?that makes it appear that they?re speaking on behalf of the institution? of the US military, says Maj. James Golby, an instructor of politics at the US Military Academy at West Point.
The ?main issue? is ?respecting the moral authority that has been bestowed on people who have served in the military to guard? the trust the public has placed in them, adds Golby, lead author in the new study entitled, ?Military Campaigns: Veterans? Endorsements and Presidential Elections,? from the Center for a New American Security in Washington.
The problem is that very few American voters make the distinction between retired military personnel and those on active duty, notes the study, which was also written by Kyle Dropp and Peter Feaver. Active-duty personnel are not allowed to wear uniforms at political events and make political speeches.
The campaigns, in turn, are aware of this and tend to recruit the highest-ranking retirees they can find to support candidates, particularly ?flag officers? ? admirals and generals.
?Retired senior officers may think they are drawing fine distinctions between the formal institution of active-duty military and their own views as retired citizens, but the truth is that no one, especially not the campaigns, is very interested in their views as private citizens,? the study says.
While the report finds that these endorsements do not appear to notably sway voters, the problem is that over time these endorsements have the potential to erode trust in the military.
What's more, the topic is particularly relevant during a presidential election in which, for the first time in American history, neither of the candidates has served in the military.
?Endorsements by retired military officers can diminish the perception of the military as a nonpartisan institution serving the nation and increase the perception of the military as just another interest group serving its own bureaucratic and political interests,? the authors warn.
Because of this, endorsements from retired military officers ? particularly the high-ranking ones ? could be seen as coming with a thinly veiled threat about what could happen if the nonpreferred candidate wins.
This is particularly true of some of the negative political ads this campaign season, when retired Special Operations Forces officers attacked President Obama for discussing the strike on Osama bin Laden?s compound, Golby says.
?The real downside to negative ads is that they do create a perception that the military doesn?t support one candidate, and they raise questions about whether military leaders will be able to faithfully carry out the orders of the other party,? he says.
As the report notes, ?Indeed, the military is obliged to serve wholeheartedly whichever candidate wins, and public participation in the campaign process undermines the perception that it can or will do so if the vote goes against members? preferences.?
For this reason, the nation?s highest-ranking military officer, Gen. Martin Dempsey, chairman of the Joint Chiefs of Staff, has weighed in on the issue.
?In my judgment, we must continue to be thoughtful about how our actions and opinions reflect on the profession beyond active service,? he wrote in a message to US troops. ?Former and retired service members, especially generals and admirals, are connected to military service for life. When the title or uniform is used for partisan purposes, it can erode the trust relationship.?
The report?s authors acknowledge that the vast majority of retired officers who make endorsements have only the interests of their country at heart. ?Many of these retired generals and admirals have served their nation faithfully for many years and have noble ambitions. They are pursuing what they think is right in terms of broader policies for the nation,? Golby says.
What?s more, veterans groups have legitimate concerns about issues that elected officials address ? or choose not to ? after having ?born the brunt? of America?s two wars for a decade, he notes, adding that no one is suggesting that veterans forgo voting.
The key may be weighing these endorsements ? particularly among high-profile, high-ranking officers ? against the greater good for the nation. In any event, "the message of such endorsements is clear and unmistakable," the report concludes. '' 'I am a distinguished military voice speaking on behalf of the military. Because ?we the military? trust this person to be commander-in-chief, you can, too.' "

We work with children over a broad age range, from 3-18 years old; recreation to high school level players. I myself coach around 200 4-12 year old children per week and as a rough estimate, at least 50% bring sports drinks. Sports drinks are a multi-billion dollar industry, but how important are they in youth soccer?
The main use of a sports drink is to replace electrolytes ? electrically charged ions which maintain the body?s ability to transmit nerve impulses and contract muscles. They also help water balance and distribution to working cells in the body. The President?s Council of Sports and Fitness state that ?electrolyte replacement is not needed during short bursts of exercise since sweat is approximately 99% water and less than 1% electrolytes.?
Simply looking in public domains, e.g. the internet, books and word of mouth, the general consensus is that Sports Drinks are nominally at best beneficial in a youth?s performance. Advertising plays an astronomical part in promoting these types of drinks ? using famous players, colorful flavors and strong guarantees of performance-enhancing nutrients and supplements inside. Heneghan et al (2012) studied over a thousand advertisements, websites and adverts from sports hydration manufacturers, ?covering 431 performance enhancing claims in 104 products. Only 146 of these had any sort of reference to back this up. Over 52% of these performance-enhancing claims had no scientific reference or acknowledgement? and ?80% of the entire statements were shown to have a high bias towards their product?.
Brown (2009) explains that ?The usual foods we eat contain far more electrolytes than sports drinks. For example, a medium banana contains about 450mg of potassium, whereas Gatorade provides 30mg per 8-ounce serving?. After a long run, a meal consisting of 8 ounces of yogurt and a can of chicken noodle soup would adequately replace lost electrolytes (potassium and sodium)?' With this information explained on the basis of an adult?s daily requirements, seeing a child turn up with a 32oz bottle of a sport drink makes you wonder where the excess nutrients are going. The body can only ingest a set amount of each nutrient (dependant on a host of factors like age, weight etc) so the excess is being lost. Anyone who has had an ?old-school? electrolyte drink of water, sugar and salt knows how vile it can taste, hence the need for these drinks to have added sweeteners and sugar. These add to the calorific value of the drink ?suddenly we are adding excess sugar and calories in a nation where obesity is a massive focal issue. A friend of mine ? a holistic personal trainer ? suggested we should use a 90/10% diet ? 90% natural foods in their form and 10% of manufactured foods as rewards. The chemicals, dyes and artificial sweeteners in sugar free drinks can potentially be even worse than sugary drinks. Water is the body?s preferred way to rehydrate, and surely must be better than a chemically enhanced product where long term health benefits haven?t been proved?

3. Applicable Players' Share:
? For each of the six (6) years of the CBA (and any additional one-year option) the Players' Share shall be Fifty (50) percent of Actual HRR.
4. Payroll Range:
? Payroll Range will be computed using existing methodology. For the 2012/13 season, the Payroll Range will be computed assuming HRR will remain flat year-over-year (2011/12 to 2012/13) at $3.303 Billion (assuming Preliminary Benefits of $95 Million).
? 2012/13 Payroll Range
Lower Limit = $43.9 Million
Midpoint = $51.9 Million
Upper Limit = $59.9 Million
? Appropriate "Transition Rules" to allow Clubs to exceed Upper Limit for the 2012/13 season only (but in no event will Club's Averaged Club Salary be permitted to exceed the pre-CBA Upper Limit of $70.2 Million).

5. Cap Accounting:
? Payroll Lower Limit must be satisfied without performance bonuses.
? All years of existing SPCs with terms in excess of five (5) years will be accounted for and charged against a team's Cap (at full AAV) regardless of whether or where the Player is playing. In the event any such contract is traded during its term, the related Cap charge will travel with the Player, but only for the year(s) in which the Player remains active and is being paid under his NHL SPC. If, at some subsequent point in time the Player retires or ceases to play and/or receive pay under his NHL SPC, the Cap charge will automatically revert (at full AAV) to the Club that initially entered into the contract for the balance of its term.
? Money paid to Players on NHL SPCs (one-ways and two-ways) in another professional league will not be counted against the Players' Share, but all dollars paid in excess of $105,000 will be counted against the NHL Club's Averaged Club Salary for the period during which such Player is being paid under his SPC while playing in another professional league.
? In the context of Player Trades, participating Clubs will be permitted to allocate Cap charges and related salary payment obligations between them, subject to specified parameters. Specifically, Clubs may agree to retain, for each of the remaining years of the Player's SPC, no more than the lesser of: (i) $3 million of a particular SPC's Cap charge or (ii) 50 percent of the SPC's AAV ("Retained Salary Transaction"). In any Retained Salary Transaction, salary obligations as between Clubs would be allocated on the same percentage basis as Cap charges are being allocated. So, for instance, if an assigning Club agrees to retain 30% of an SPC's Cap charge over the balance of its term, it will also retain an obligation to reimburse the acquiring Club 30% of the Player's contractual compensation in each of the remaining years of the contract. A Club may not have more than two (2) contracts as to which Cap charges have been allocated between Clubs in a Player Trade, and no more than $5 million in allocated Cap charges in the aggregate in any one season.

6. System Changes:
? Entry Level System commitment will be limited to two (2) years (covering two full seasons) for all Players who sign their first SPC between the ages of 18 and 24 (i.e., where the first year of the SPC only covers a partial season, SPC must be for three (3) years).
? Maintenance of existing Salary Arbitration System subject to: (i) total mutuality of rights with regard to election as between Player and Club, and (ii) eligibility for election moved to five years of professional experience (from the current four years).
? Group 3 UFA eligibility for Players who are 28 or who have eight (8) Accrued Seasons (continues to allow for early UFA eligibility -- age 26).
? Maximum contract length of five (5) years.
? Limit on year-to-year salary variability on multi-year SPCs -- i.e., maximum increase or decrease in total compensation (salary and bonuses) year-over-year limited to 5% of the value of the first year of the contract. (For example, if a Player earns $10 million in total compensation in Year 1 of his SPC, his compensation (salary and bonuses) cannot increase or decrease by more than $500,000 in any subsequent year of his SPC.)
? Re-Entry waivers will be eliminated, consistent with the Cap Accounting proposal relating to the treatment of Players on NHL SPCs playing in another professional league.
? NHL Clubs who draft European Players obtain four (4) years of exclusive negotiating rights following selection in the Draft. If the four-year period expires, Player will be eligible to enter the League as a Free Agent and will not be subject to re-entering the Draft.
?
7. Revenue Sharing:
? NHL commits to Revenue Sharing Pool of $200 million for 2012/13 season (based on assumption of $3.303 Billion in actual HRR). Amount will be adjusted upward or downward in proportion to Actual HRR results for 2012/13. Revenue Sharing Pools in future years will be calculated proportionately.
? At least one-half of the total Revenue Sharing Pool (50%) will be raised from the Top 10 Revenue Grossing Clubs in a manner to be determined by the NHL.
? The distribution of the Revenue Sharing Pool will be determined on an annual basis by a Revenue Sharing Committee on which the NHLPA will have representation and input.
? For each of the first two years of the CBA, no Club will receive less in total Revenue Sharing than it received in 2011/12.
? Current "Disqualification" criteria in CBA (for Clubs in Top Half of League revenues and Clubs in large media markets) will be removed.
? Existing performance and "reduction" standards and provisions relating to "non-performers" (i.e., CBA 49.3(d)(i) and 49.3(d)(ii)) will be eliminated and will be adjusted as per the NHL's 7/31 Proposal.?
?
8. Supplemental and Commissioner Discipline:
? Introduction of additional procedural safeguards, including ultimate appeal right to a "neutral" third-party arbitrator with a "clearly erroneous" standard of review.

9. No "Rollback":
? The NHL is not proposing that current SPCs be reduced, re-written or rolled back. Instead, the NHL's proposal retains all current Players' SPCs at their current face value for the duration of their terms, subject to the operation of the escrow mechanism in the same manner as it worked under the expired CBA.
?
10. Players' Share "Make Whole" Provision:
? The League proposes to make Players "whole" for the absolute reduction in Players' Share dollars (when compared to 2011/12) that is attributable to the economic terms of the new CBA (the "Share Reduction"). Using an assumed year-over-year growth rate of 5% for League-wide revenues, the new CBA could result in shortfalls from the current level of Players' Share dollars ($1.883 Billion in 2011/12) of up to $149 million in Year 1 and up to $62 million in Year 2, for which Players will be "made whole." (By Year 3 of the new CBA, Players' Share dollars should exceed the current level ($1.883 Billion for 2011/12) and no "make whole" will be required.) Any such "shortfalls" in Years 1 and 2 of the new CBA will be computed as a percentage reduction off of the Player's stated contractual compensation, and will be repaid to the Player as a Deferred Compensation benefit spread over the remaining future years of the Player's SPC (or if he has no remaining years, in the year following the expiration of his SPC). Player reimbursement for the Share Reduction will be accrued and paid for by the League, and will be chargeable against Players' Share amounts in future years as Preliminary Benefits. The objective would be to honor all existing SPCs by restoring their "value" on the basis of the now existing level of Players' Share dollars.

NHL'S PROPOSAL TO NHLPA TO SAVE THE 82-GAME 2012/13 SEASON
We have reached a critical point in our collective bargaining negotiations. In an attempt to save an 82-game 2012/13 season (including the usual schedule of Playoff Games), the NHL is making a substantially revised proposal to the NHLPA regarding the critical issues on which the parties have been separated and which are essential to an agreement with the NHLPA on a new CBA moving forward. We believe that the proposal set forth below is fair to the Players and the teams, and good for the game and our fans.
This proposal is based on what we believe is a fair sharing of revenues as between the Players and the Clubs.
This proposal does not require any roll-back in the salaries of Players, and attempts to recognize and protect prior contractual commitments.
This proposal provides for increased revenue sharing, targeted to those teams that are most in need.
This proposal is our best attempt to save an 82-game 2012/13 season, and is, in fact, the best we can responsibly do.
Our negotiations with the NHLPA have failed to progress on the most critical economic and system-related issues. After considerable deliberation, we have decided to make this proposal because time is of the essence. Specifically, in order to save the full 82-game season, the Regular Season schedule will have to commence no later than November 2, with 7-day Club Training Camps that must open by October 26. As a practical matter, this means we must conclude a new written CBA by October 25. We believe the parties can achieve this and that by working together, we can jointly preserve an 82-game season for our Players, our Clubs, and most importantly, for our fans.
Delay (beyond October 25) will necessarily leave us with an abbreviated season and will require the cancellation of signature NHL events. Failure to reach a prompt agreement will also have other significant and detrimental impacts on our fans, the game, our Clubs, our business and the communities in which we play. All of this will obviously necessitate changes to this offer in the event we are unsuccessful in saving a full season.
Here are the elements of our proposal and a brief explanation:
Term
The term of the CBA proposed by the League -- 6 years, plus a mutual option for a 7th year -- is consistent with the term of the expired CBA. It will allow for our fans, the Players and the Clubs to enjoy a reasonable and extended period of labor peace thereby enhancing the short to medium term business planning of the parties. During this time, the League and the Players can work together to continue to build on the momentum the NHL has experienced over the course of the past 7 years, both on and off the ice.?

HRR Accounting
We agree to retain the CBA's current HRR definitions. Further, we propose to formalize the various agreements the NHLPA and the NHL have reached, and lived under, during the course of the expired CBA, and to clarify mutually identified ambiguities in the CBA. Importantly, we do not believe any of our proposed clarifications should have any impact either on the amount of the Players' Share or the amount that any individual Player is entitled to receive. None of these clarifications for instance, would have had a material impact on the 2011/12 Actual HRR number. This proposal is all about certainty, clarity and speeding up our complex, end-of-year accounting process.?

Applicable Players' Share
We believe a 50-50 sharing of Actual HRR is a fair allocation and a reasonable compromise as between Players and Clubs. The simple fact of the matter is that it costs Clubs more money now to operate and to generate revenues than it used to. These increased costs include amounts dedicated to the health, safety and enhanced comfort of NHL Players, the increased costs associated with generating ticket and gameday revenues, and the significant capital investments that are regularly being made around the League to enhance the fan experience and to create new revenue streams. The proposed 50-50 sharing arrangement, comparable to the sharing arrangements in the NFL and the NBA, will enable the NHL to protect and promote the long-term future of the game, the financial health and stability of the Clubs and the long-term earning capacity of the Players.?

Payroll Range
We propose to set the 2012/13 Payroll Range on the basis of last season's Actual HRR, using the same methodology as used in the recently expired CBA. While this will result in a reduced Upper Limit for 2012/13, we have also proposed to permit the Clubs to exceed the Payroll Range this year, to a maximum of $70.2 million ? which was the Cap established prior to this past summer. This will allow a Club that chooses to do so to maintain or enhance its current roster during a full-year transition period.?

Cap Accounting
We are proposing that a Club's Lower Limit obligation be satisfied without reference to (or inclusion of) performance bonuses. This will effectively increase the minimum commitment of actual compensation paid by the "Lower Limit Clubs" to Players. The proposal acknowledges the League's agreement to a request made by the NHLPA earlier in our negotiations.
We are proposing that all years of existing long-term contracts in excess of five (5) years be counted against a Club's Cap regardless of whether or where a Player is playing. While such contracts (and Cap charges) can be traded during their terms, in the event a Player subsequently retires or ceases to play, the effective Cap charge would revert to the Club that originally entered into the contract. This proposal is consistent with our other proposals intended to address the harmful effects of long-term, front-loaded, "back-diving" contracts.
We are proposing that the salaries of minor league Players on NHL contracts (above a threshold of $105,000) be counted against a Club's Cap. This provision is intended to prevent Clubs from "stashing" or assigning players to the minors (or any other professional league) for "Cap management" purposes. We are not proposing that any salary paid to minor league Players on NHL contracts be counted against the Players' Share.
Finally, we propose that to facilitate more trades and create increased flexibility in managing Cap Room, Clubs be allowed to allocate portions of a contract's Cap charge (and related salary obligations) in the context of a Player Trade. This will facilitate additional Player movement and trades between teams as they manage their respective Caps and Payroll Range obligations.

System Changes
We also propose making certain modest modifications to existing elements of the current system,?none of which will affect the total dollars to which the Players are entitled; they will address instead the allocation of those dollars as among various categories of Players, and we believe should ensure and improve the competitive balance and quality of play around the League as a result.
In our opinion, and as we have expressed in prior bargaining sessions, certain elements of the current system have produced a dynamic that has led to a misallocation of Players' Share dollars in favor of those Players coming out of the Entry Level System at the expense of other, more proven and established Players. We are therefore proposing the following to hopefully address this dynamic:
(1) We have withdrawn our initial proposal that would have provided Clubs with an option to extend the terms of Entry Level contracts, and instead are proposing to reduce the duration of the Entry Level System from three years to two years, thereby allowing entering NHL Players an earlier opportunity to become Restricted Free Agents. This will free up more money currently committed to Entry Level Players in their third years who are no longer legitimate NHL prospects and will also allow talented NHL prospects an opportunity to negotiate non-ELS contracts earlier in their careers.
(2) We have withdrawn our initial proposal to eliminate Salary Arbitration. We are instead proposing to maintain the Salary Arbitration mechanism, and are further proposing that the rights of Players and Clubs to elect Salary Arbitration be made mutual. Moreover, we are proposing to revise the eligibility criteria for Salary Arbitration to five years of professional experience (instead of the current four years), the same criteria as existed under the 1994-2004 CBA.
(3) We have withdrawn our initial proposal to revise the eligibility requirements for Unrestricted Free Agency to 10 Accrued Seasons, and are instead proposing a modest single year adjustment to 28 years of age or 8 Accrued Seasons. This proposal still allows for the possibility of early UFA status for Players -- as early as age 26.
All three of these system proposals are designed to shift the current allocation of Players' Share dollars away from "second contracts" and toward "third and subsequent contracts" to ensure what we believe to be a more equitable and effective allocation of Players' Share dollars to more proven, established Players who are playing in the prime of their NHL careers.
We are also proposing two additional system modifications that are intended to address the recent phenomenon of long-term, front-loaded, "back-diving" Player contracts that we believe has proven harmful to the interests of our Clubs and has clearly had the purpose and effect of circumventing the letter and spirit of our existing system. In addition, these contracts have increased the Escrow obligation and reduced the effective salaries of Players playing under "normal" contracts. In order to mitigate the consequences of these contracts, we have proposed 5-year term limits for SPCs and tighter restrictions on the year-over-year salary variability of contracts.
Due to our proposed change in the Cap treatment of minor league Players on NHL SPCs, we are proposing the elimination of the Re-Entry Waivers provision. The elimination of this provision, coupled with the ability to allocate Cap charges and salary in trades, should lend themselves to fewer NHL-caliber Players being relegated to minor league service for prolonged periods of time.
Finally, in order to help preserve the vibrancy and stability of European professional leagues as a continued source of NHL talent, we are proposing to convert the typical four-year period of exclusive negotiating rights that attach to European Players from the current "two-plus-two" model (with each Player being subject to having to re-enter the Draft) to a straight "four-year" model (with no obligation to re-enter the Draft).

Revenue Sharing
The NHL has proposed to increase the Revenue Sharing pool for 2012/13 to $200 million (assuming League-wide revenues of $3.303 Billion), representing an approximately 33% increase over the amount that will be distributed on account of 2011/12. This enhanced amount is at least comparable to the levels of revenue sharing in the NBA and MLB, and will be adjusted proportionately upward or downward based on Actual HRR results in future seasons.
At least 50% of the Revenue Sharing pool will be funded by the Top 10 Revenue Grossing teams. The remainder of the Revenue Sharing pool will be funded from League- and Playoff-generated revenues.
The Revenue Sharing pool will be redistributed to those Clubs who are in the most need in order to enable those teams to have sufficient resources on hand to compete for and compensate Players within the Payroll Range, and otherwise to provide a basis for their continued financial stability. In this regard, we are proposing to commit for the next two years revenue sharing payments to recipient Clubs that are equivalent to or greater than what those Clubs will receive on account of the 2011/12 season. The effect should be to continue -- and even improve -- the historic and unprecedented quality of play and level of competitive balance we have jointly been able to achieve during the period of the recently expired CBA.
All Clubs in the NHL except the top 10 Revenue Grossing Clubs will now be eligible for Revenue Sharing, including Clubs in large media markets who were previously ineligible (such as Anaheim, New Jersey and the?New York Islanders, among others). Further, our proposal eliminates some of the current "business performance" thresholds that had the effect of materially reducing the amounts a Club might otherwise qualify to receive in revenue sharing. Instead, under-performing Clubs will be expected to enhance their business planning capabilities, will be provided on-site assistance to meet enhanced business objectives and will be provided with much greater counseling as to "best practices" in business operations.
In addition, we have proposed the formation of a functioning and active Revenue Sharing Committee, on which the NHLPA will have representation and will have an opportunity to provide input, to determine the best and most effective distribution of revenue sharing funds.?

Supplemental and Commissioner Discipline
We are proposing to amend current Player discipline provisions to introduce additional procedural safeguards to protect Player interests, including an ultimate appeal right to a "neutral" third-party arbitrator with a "clearly erroneous" standard of review.

No Rollback; Players' Share "Make Whole" Provision
The NHL is?not?proposing that current SPCs be reduced, re-written or rolled back. Instead, the NHL's proposal retains all current Players' SPCs at their current face value for the duration of their terms, subject to the operation of the escrow mechanism in the same manner as it has worked under the expired CBA. (In other words, under the expired CBA, the compensation a Player received each year was either higher or lower than the face value of his contract depending upon Club-Player contracting levels and the level and growth rate of HRR.) Under the expired CBA, in two of the seven years Players were paid in excess of the face values of their SPCs and in five of those years they received less than their face values. That process would remain intact under the new CBA.
Under our "make whole" proposal, which is premised upon a 5% anticipated growth of HRR both this year and in future years, every Player will be paid compensation based on the full value of the Players' Share under which his current SPC was signed.
In order to effectively transition from a Players' Share of 57 percent to 50 percent, including importantly to protect Players' current SPCs against an absolute reduction in Players' Share dollars, the new Agreement contemplates, in its initial years, a "make whole" mechanism that will effectively pay each Player currently under contract the difference between 50% of Actual HRR in 2012/13 and 57% of HRR in 2011/12 -- which was $1.883 Billion.
Again, premised upon an assumed 5% growth rate between 2011/12 and 2012/13, the "make whole" amount is calculated to be a maximum of $149 million for the 2012/13 season ($1.883 Billion minus $1.734 Billion (57% multiplied by $3.303 Billion minus 50% multiplied by $3.468 Billion). Similarly, utilizing that formula and our 5% growth projections, the "make whole" amount is calculated to be a maximum of $62 million for the 2013/14 season.
To accomplish the "make whole," each Players' pro-rata "make whole" will be determined for the first two years of the Agreement and will be paid to each Player as a Deferred Compensation benefit over the life of the Player's existing SPC. For those Players whose contracts expire after the 2012/13 season, the benefit will be paid when final HRR is determined for this season (in October/November 2013). Player "make whole" payments will be accrued and paid for by the League, and will be chargeable against Players' Share amounts in future years as Preliminary Benefits.
The "make whole" obligation will be operational only through the 2013/14 season because, beginning in Year 3, the projected growth in League-wide revenues should have resulted in an increase in absolute Players' Share dollars (in excess of the Players' Share of $1.883 Billion in 2011/12). This will effectively restore "full value" to all existing SPCs without any continuing need for a "make whole."
We note in regard to this proposal, that while the NHLPA's August 14 proposal was premised upon a 7% annual growth rate in HRR, we instead used the more conservative growth rate of 5%, consistent with our prior proposals. If the NHLPA's estimate of revenue growth is more accurate, then the amount of money needed to effectuate a "make whole" would actually be less.

The parties have already reached agreement on many of the non-critical but necessary items needed to complete a new CBA. We hope the NHLPA and the Players will view this proposal in the manner in which it is intended -- an invitation to complete an Agreement in the necessary timeframe so that a full 82-game 2012/13 season can be saved.
